شروط الاستخدام
١. قبول الشروط
باستخدامك تطبيق كومنتات أو موقع commentat.net، فإنك تبرم اتفاقًا ملزمًا مع . إن كنت لا توافق على أي بند من هذه الشروط، فالرجاء عدم استخدام الخدمة.
تُقرأ هذه الشروط مع سياسة الخصوصية وإرشادات المجتمع، وكلاهما جزء لا يتجزأ من هذا الاتفاق.
٢. أهلية الاستخدام
- يجب أن يكون عمرك ١٨ سنة فأكثر.
- ألا تكون قد أُوقف حسابك سابقًا لمخالفة هذه الشروط.
- ألا يمنعك أي نظام سارٍ في بلدك من استخدام الخدمة.
إن اكتشفنا أنك دون السن النظامية، سنغلق حسابك ونحذف بياناتك.
٣. حسابك
- قدّم بيانات صحيحة وحدّثها عند تغيّرها.
- أنت المسؤول الوحيد عن سرية بيانات دخولك وعن كل نشاط يتم عبر حسابك.
- لا تنشئ حسابات متعددة بغرض التحايل على إيقاف أو حظر.
- لا تبع حسابك ولا تنقله ولا تؤجّره.
- أبلغنا فورًا على عند أي استخدام غير مصرّح به لحسابك.
٤. قواعد المحتوى والسلوك
كومنتات مساحة للنقاش لا للأذى. يُمنع منعًا باتًا نشر أو إرسال أو الترويج لما يلي:
- أي محتوى جنسي صريح، أو إباحي، أو موادّ الاعتداء الجنسي على الأطفال بأي شكل.
- التحرش، أو التنمّر، أو التهديد، أو الملاحقة، أو التشهير بالأشخاص.
- خطاب الكراهية أو التحريض ضد أي فرد أو جماعة على أساس الدين أو العرق أو الجنس أو الجنسية أو الإعاقة.
- العنف الصريح، أو التحريض عليه، أو الترويج للإرهاب أو التطرف.
- الترويج للانتحار أو إيذاء النفس أو اضطرابات الأكل.
- المحتوى المخالف للأنظمة السعودية أو المسيء للدين أو الرموز الدينية.
- الاحتيال، أو الاحتيال المالي، أو الرسائل المزعجة، أو التسويق الهرمي، أو المقامرة.
- بيع أو الترويج للمخدرات أو الأسلحة أو أي سلع محظورة نظامًا.
- انتحال شخصية أي فرد أو جهة، أو ادّعاء صفة رسمية زورًا.
- نشر بيانات شخصية لأي شخص دون إذنه (doxxing) — بما فيها الصور الخاصة.
- محتوى ينتهك حقوق ملكية فكرية تعود للغير.
- البرمجيات الضارة، أو الروابط الخبيثة، أو محاولات اختراق الخدمة أو مستخدميها.
- الحسابات الآلية، أو الكشط (scraping)، أو التلاعب بالتفاعل والانتشار.
٥. ملكية المحتوى والترخيص
محتواك يبقى ملكك. لا ندّعي ملكية ما تنشره.
لكن لكي نتمكن من تشغيل الخدمة تقنيًا، تمنحنا ترخيصًا غير حصري، عالميًا، مجانيًا، قابلًا للترخيص من الباطن لمزوّدي الاستضافة فقط، لاستضافة محتواك وتخزينه ونسخه وعرضه وتعديل أبعاده التقنية (كضغط الصور) — وذلك لغرض تشغيل كومنتات وحده.
ينتهي هذا الترخيص عند حذفك للمحتوى أو لحسابك، عدا ما تقتضيه النسخ الاحتياطية خلال مدة استبدالها، وما نُلزم بالاحتفاظ به نظامًا.
٦. الإبلاغ والحظر والإشراف
وفّرنا لك أدوات فعلية للتحكم بتجربتك:
- الإبلاغ: عن أي منشور أو تعليق أو حساب من قائمة الخيارات (⋯) بجانبه.
- الحظر: لمنع أي مستخدم من رؤية محتواك أو مراسلتك.
- الإخفاء: لإزالة محتوى من ظهورك دون حظر صاحبه.
نراجع البلاغات المتعلقة بالمحتوى المسيء خلال ٢٤ ساعة، وبلاغات سلامة الأطفال فورًا. نستخدم فلترة آلية للنصوص والصور قبل النشر، إضافةً إلى مراجعة بشرية للحالات المُبلَّغ عنها. قد نحذف أي محتوى مخالف دون إشعار مسبق.
٧. الاشتراكات المدفوعة (Plus و VIP)
- تتم جميع عمليات الشراء عبر App Store أو Google Play حصرًا، ووفق شروط المتجر المعني.
- الاشتراك يتجدد تلقائيًا ما لم تلغِه قبل ٢٤ ساعة على الأقل من نهاية الفترة الحالية.
- تُخصم قيمة التجديد من حسابك في المتجر خلال الـ٢٤ ساعة الأخيرة من الفترة الجارية.
- تدير اشتراكك وتلغيه من إعدادات حسابك في المتجر، وليس من داخل التطبيق.
- سياسة الاسترداد تخضع لسياسة المتجر — نحن لا نعالج المدفوعات ولا نستطيع ردّها مباشرة.
- إلغاء الاشتراك لا يحذف حسابك؛ تفقد فقط مزايا الباقة عند انتهاء الفترة المدفوعة.
- الأسعار قد تتغير، ونشعرك قبل أي تغيير يسري على تجديدك.
٨. الإيقاف وإنهاء الحساب
قد نُقيّد أو نوقف أو نُنهي حسابك في الحالات التالية:
- مخالفة هذه الشروط أو إرشادات المجتمع.
- وجود خطر على مستخدمين آخرين أو على الخدمة.
- الاستجابة لأمر نظامي.
نُشعرك بالسبب وبمدة الإيقاف كلما كان ذلك ممكنًا، ويحق لك التظلّم عبر خلال ٣٠ يومًا. أما أنت فيمكنك إنهاء حسابك متى شئت عبر صفحة حذف الحساب.
٩. حقوق الملكية الفكرية
اسم «كومنتات» و«Commentat» وشعاره وتصميم التطبيق وشيفرته البرمجية مملوكة لنا. لا يجوز نسخها أو تعديلها أو هندستها عكسيًا أو استخدامها تجاريًا دون إذن كتابي مسبق.
إن كنت تعتقد أن محتوى على كومنتات ينتهك حقوقك، راسلنا على موضّحًا العمل المحمي ورابط المحتوى المخالف وبيانات التواصل معك.
١٠. إخلاء المسؤولية
تُقدَّم الخدمة «كما هي». لا نضمن خلوّها من الانقطاع أو الأخطاء، ولا نضمن دقة المحتوى الذي ينشره المستخدمون أو صحته. آراء المستخدمين تعبّر عنهم وحدهم ولا تمثّلنا.
١١. حدود المسؤولية
في الحدود التي تسمح بها الأنظمة، لا نتحمل المسؤولية عن الأضرار غير المباشرة أو التبعية أو فقد الأرباح أو البيانات. وفي جميع الأحوال لا تتجاوز مسؤوليتنا الإجمالية المبالغ التي دفعتها فعليًا خلال الاثني عشر شهرًا السابقة للواقعة، أو مئة (١٠٠) ريال سعودي، أيهما أعلى.
١٢. التعويض
توافق على تعويضنا عن أي مطالبة أو خسارة تنشأ عن مخالفتك لهذه الشروط أو عن محتوى نشرته.
١٣. تعديل الخدمة والشروط
قد نطوّر الخدمة أو نوقف ميزات منها. وسنُشعرك بأي تعديل جوهري على هذه الشروط قبل ٣٠ يومًا من سريانه. إن لم توافق، يمكنك إنهاء حسابك قبل تاريخ السريان.
١٤. النظام الواجب التطبيق
تخضع هذه الشروط لأنظمة المملكة العربية السعودية، وتختص الجهات القضائية السعودية بالنظر في أي نزاع ينشأ عنها. ولا يخلّ ذلك بحقوقك الإلزامية بصفتك مستهلكًا في بلد إقامتك.
١٥. أحكام عامة والتواصل
- إذا بطل بند، تبقى بقية البنود سارية.
- عدم ممارستنا لحق ما لا يعني التنازل عنه.
- تمثّل هذه الشروط مع سياسة الخصوصية وإرشادات المجتمع كامل الاتفاق بيننا.
Terms of Service
1. Acceptance
By using the Commentat app or commentat.net you enter into a binding agreement with . If you do not agree with any part of these Terms, please do not use the service.
These Terms are read together with our Privacy Policy and Community Guidelines, both of which form part of this agreement.
2. Eligibility
- You must be 18 or older.
- Your account must not have been previously terminated for a violation.
- No law in your country may prohibit you from using the service.
If we find you are under age, we will close the account and delete the data.
3. Your account
- Provide accurate information and keep it current.
- You are solely responsible for your credentials and all activity under your account.
- Do not create multiple accounts to evade a suspension or block.
- Do not sell, transfer or rent your account.
- Tell us immediately at about any unauthorised use.
4. Content and conduct rules
Commentat is a space for discussion, not harm. The following are strictly prohibited:
- Sexually explicit or pornographic material, and child sexual abuse material in any form.
- Harassment, bullying, threats, stalking or defamation.
- Hate speech or incitement against any person or group based on religion, race, sex, nationality or disability.
- Graphic violence, incitement to violence, or promotion of terrorism or extremism.
- Promotion of suicide, self-harm or eating disorders.
- Content unlawful under Saudi law or offensive to religion or religious symbols.
- Fraud, financial scams, spam, pyramid schemes or gambling.
- Sale or promotion of drugs, weapons or other legally restricted goods.
- Impersonating any person or organisation, or falsely claiming official status.
- Publishing anyone's personal data without consent (doxxing), including private images.
- Content infringing third-party intellectual property.
- Malware, malicious links, or attempts to attack the service or its users.
- Bots, scraping, or manipulation of engagement and reach.
5. Content ownership and licence
Your content stays yours. We claim no ownership over what you post.
To operate the service technically, you grant us a non-exclusive, worldwide, royalty-free licence, sublicensable only to our hosting providers, to host, store, reproduce, display and technically adapt your content (such as compressing images) — solely for the purpose of running Commentat.
This licence ends when you delete the content or your account, except for backups during their rotation period and anything we are legally required to retain.
6. Reporting, blocking and moderation
- Report any post, comment or account from the (⋯) menu beside it.
- Block to stop a user seeing your content or messaging you.
- Hide to remove content from your view without blocking its author.
We review reports of abusive content within 24 hours, and child-safety reports immediately. We use automated text and image screening before publication, plus human review of reported cases. We may remove violating content without prior notice.
7. Paid subscriptions (Plus and VIP)
- All purchases are made exclusively through the App Store or Google Play, subject to that store's terms.
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
- Renewal is charged to your store account within the last 24 hours of the current period.
- You manage and cancel your subscription in your store account settings, not in the app.
- Refunds follow the store's policy — we do not process payments and cannot refund directly.
- Cancelling does not delete your account; you simply lose plan benefits when the paid period ends.
- Prices may change, and we will notify you before any change applies to your renewal.
8. Suspension and termination
We may restrict, suspend or terminate your account if:
- you violate these Terms or the Community Guidelines;
- there is a risk to other users or to the service;
- we are required to by a lawful order.
We tell you the reason and duration wherever possible, and you may appeal at within 30 days. You can end your account at any time via the account deletion page.
9. Intellectual property
The names "Commentat" and "كومنتات", the logo, the app design and its source code belong to us. They may not be copied, modified, reverse-engineered or used commercially without prior written permission.
If you believe content on Commentat infringes your rights, write to identifying the protected work, a link to the infringing content, and your contact details.
10. Disclaimer
The service is provided "as is". We do not warrant that it will be uninterrupted or error-free, nor do we warrant the accuracy of user-posted content. User opinions are their own and do not represent us.
11. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential damages, or loss of profits or data. In any event our total liability will not exceed the amounts you actually paid in the twelve months preceding the event, or SAR 100, whichever is greater.
12. Indemnity
You agree to indemnify us against any claim or loss arising from your breach of these Terms or from content you posted.
13. Changes
We may develop the service or discontinue features. We will notify you of any material change to these Terms 30 days before it takes effect. If you disagree, you may close your account before the effective date.
14. Governing law
These Terms are governed by the laws of the Kingdom of Saudi Arabia, and Saudi courts have jurisdiction over any dispute. This does not affect mandatory consumer rights you have in your country of residence.
15. General and contact
- If any provision is invalid, the rest remain in force.
- Not exercising a right does not waive it.
- These Terms, with the Privacy Policy and Community Guidelines, are the entire agreement.
